These Terms of Use (“Terms”) are a legal agreement between you and Digisaint Private Limited (“Digisaint”, “we”, “our”, or “us”). They govern your access to and use of our websites, mobile and watch applications, widgets, live activities, and related products and services, including Purple Sector, Hoopster, MotoZ, and products introduced in the future (collectively, the “Services”).
By downloading, accessing, purchasing, subscribing to, or using a Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. Product-specific terms displayed in a Service supplement these Terms and control for that product if there is a conflict.
1. Eligibility and Accounts
You must be legally capable of entering into these Terms. If you are under the age of legal majority where you live, a parent or legal guardian must review and accept these Terms for you. The Services are not directed to children under 13.
If a Service offers accounts, you must provide accurate information, safeguard your credentials, and promptly notify us of unauthorized use. You are responsible for activity through your account except to the extent prohibited by law.
2. License and Permitted Use
Subject to these Terms, Digisaint grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use the Services on devices you own or control for personal, non-commercial use, subject to applicable app-store rules.
You may not:
- Use the Services for unlawful, fraudulent, abusive, or unauthorized purposes.
- Copy, sell, rent, sublicense, distribute, or commercially exploit the Services except as expressly permitted.
- Reverse engineer, decompile, bypass, modify, or create derivative works except where law expressly permits it.
- Interfere with security, access controls, networks, servers, or another user’s experience.
- Use bots, scrapers, automated extraction, or bulk access without written permission.
- Upload malicious code, impersonate others, infringe rights, or use data from the Services to build a competing database or service.
3. Informational Content
The Services may provide sports schedules, scores, statistics, standings, predictions, news, notifications, widgets, and similar information. This content is provided for general informational and entertainment purposes. It may be delayed, incomplete, or inaccurate and is not professional, financial, wagering, medical, or legal advice.
You are responsible for decisions made using the Services. Do not rely on the Services where an error or delay could cause loss, injury, or other material harm.
4. Purchases and Subscriptions
Some Services may offer paid features, subscriptions, or in-app purchases. Prices, billing periods, trial terms, renewal terms, and included features are shown before purchase. Purchases are processed by Apple, Google, or another payment provider and are also governed by that provider’s terms.
- Subscriptions may renew automatically unless canceled through your app-store account before renewal.
- Deleting an app does not cancel a subscription.
- Refunds, billing disputes, and payment-method changes are handled under the applicable store or payment-provider rules, except where law requires otherwise.
- Taxes and currency conversion may apply.
5. Intellectual Property
The Services, including software, design, text, graphics, original data organization, features, and Digisaint branding, are owned by or licensed to Digisaint and protected by intellectual-property laws. These Terms do not transfer ownership to you.
Third-party names, leagues, competitions, teams, drivers, riders, players, logos, statistics, and other materials remain the property of their respective owners.
6. Unofficial Product and Trademark Disclaimer
Unless expressly stated otherwise, Digisaint products are independent and unofficial. They are not affiliated with, endorsed by, sponsored by, or associated with Formula 1, the FIA, Formula One Licensing, MotoGP, Dorna Sports, the National Basketball Association, NBA Properties, their teams, participants, athletes, or other rights holders.
All third-party trademarks, competition names, team names, logos, driver or rider names, player names, and related rights belong to their respective owners. References are used only to identify and describe informational content.
7. User Submissions and Feedback
If you submit feedback, suggestions, reviews, or other content, you confirm that you have the right to provide it and that it does not violate law or third-party rights. You grant Digisaint a worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, and incorporate feedback into our products without restriction or compensation.
8. Third-Party Services and Links
The Services may depend on or link to app stores, operating systems, data providers, advertisements, websites, and other third-party services. We do not control and are not responsible for their availability, content, security, terms, or privacy practices. Your use of third-party services is governed by their terms.
9. Service Changes and Availability
We may add, modify, suspend, or discontinue any Service or feature, including free or paid features. We do not guarantee uninterrupted, error-free, or permanent availability. Updates may be required for continued use. We are not responsible for failures caused by networks, devices, platforms, data providers, force majeure events, or circumstances outside our reasonable control.
10. Privacy
Our Privacy Policy explains how we process personal data. Device permissions and app-store privacy disclosures may provide additional product-specific information.
11. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available”. Digisaint disclaims all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, accuracy, availability, security, and non-infringement. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
12. Limitation of Liability
To the maximum extent permitted by law, Digisaint and its directors, employees, affiliates, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, revenue, profits, goodwill, or business opportunity; or damages arising from third-party content, service interruption, or inability to use the Services.
Where liability cannot be excluded, our aggregate liability arising from a Service will not exceed the greater of the amount you paid for that Service during the twelve months before the claim or the minimum amount required by applicable law. These limitations do not apply where prohibited by law, including liability that cannot be limited for fraud, willful misconduct, or personal injury.
13. Indemnity
To the extent permitted by law, you agree to defend and indemnify Digisaint against claims, losses, and expenses arising from your unlawful use of the Services, your violation of these Terms, or your infringement of another person’s rights. This obligation does not apply to the extent a claim results from Digisaint’s own conduct.
14. Suspension and Termination
You may stop using the Services at any time. We may suspend or terminate access where reasonably necessary to address a violation, security risk, legal requirement, non-payment, abuse, or discontinuation of a Service. Provisions that by their nature should survive termination will remain in effect.
15. App-Store Terms
If you obtain a Service through Apple’s App Store or Google Play, the applicable store terms also apply. The store provider is not responsible for maintaining or supporting the Service except as required by its rules or law. For Apple-distributed Services, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable app-license provisions against you.
16. Governing Law and Disputes
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts with lawful jurisdiction in India will have jurisdiction, except that consumers retain any mandatory rights and forums available under the laws of their place of residence. Before filing a claim, please contact us and allow a reasonable opportunity to resolve the issue informally.
17. General Terms
If any provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, merger, acquisition, or transfer of a Service. These Terms and any product-specific terms are the entire agreement concerning the Services.
18. Changes to These Terms
We may update these Terms to reflect changes in the Services, law, or business practices. We will post revised Terms with a new effective date and provide additional notice where required. Continued use after the effective date constitutes acceptance, except where applicable law requires express consent.
